Supreme Court Allows Prosecutors to Appear in CGJS Prelims 2025 – Admit Cards to Be Issued

On September 19, 2025, the Supreme Court of India issued an interim order providing relief to candidates applying for the Chhattisgarh Judicial Service (CGJS) Civil Judge – Junior Division examination.

This relief specifically benefits Public Prosecutors and Government Advocates, who were previously denied admit cards by the Chhattisgarh Public Service Commission (CGPSC). The Bench, including Chief Justice of India BR Gavai, directed the CGPSC to permit these petitioners, provided they possess the requisite qualifications, to provisionally appear for the Preliminary examination scheduled for Sunday, 21st September 2025.

Eligibility Conditions Relaxed by the Supreme Court

The main issue arose from the exam notification dated 23rd December 2024, which required candidates to be enrolled as Advocates with the State Bar Council at the time of the advertisement.

Since Public Prosecutors and Government Advocates are required by rules to suspend their enrollment, the CGPSC had initially declined to issue admit cards.

The Bench headed by CJI BR Gavai clarified that:

  • Clause 3(iv)(e) (mandatory enrollment under the Advocates Act, 1961) will not be insisted upon.
  • The 3-year practice requirement will also not apply, as the notification was issued before the Supreme Court’s judgment dated 20th May 2025, which mandated such practice.
  • And therefore allowed only the petitioners

This interim order ensures that these candidates are not unfairly excluded and can participate provisionally in the CGJS Prelims 2025.

Important Caveat for Aspirants

Petitioners benefiting from this ruling should note that the Supreme Court explicitly stated that appearing in the examinations will not create any equities in their favour.

This order was passed while issuing notice on the Special Leave Petitions filed after the Chhattisgarh High Court declined to interfere with the CGPSC’s decision on 16th September 2025.

In simple terms, this update gives Prosecutors and Government Advocates the opportunity to compete provisionally under the rules that were applicable when the recruitment process began.
